General Terms and Conditions

§1 Applicability to entrepreneurs and definitions of terms:

(1) The following General Terms and Conditions of Business shall apply to all deliveries between us and a consumerin their version valid at the time of the order.

(2) "Consumer" in the sense of these terms and conditions is any natural person who enters into a legal transaction for a purpose that can be attributed neither to his commercial nor his independent professional activity.

§2 Conclusion of a contract, storage of the contract text:

(1) The following regulations on the conclusion of the contract apply to orders placed via our Internet store https://www.monolith-shop.com.

(2) In case of conclusion of the contract, the contract shall be concluded with

(3) The presentation of the goods in our Internet store does not constitute a legally binding offer of contract on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our Internet store, the following provisions shall apply: The consumer makes a binding offer to enter into a contract by successfully completing the order procedure provided in our Internet store.

The order is placed in the following steps:

1) Selection of the desired goods

2) Confirmation by clicking the "Order" button

3) checking the data in the shopping cart

4) pressing the "checkout" button

5) Login to the Internet store after registration and entering the login data (e-mail address and password).

6) Checking again or correcting the respective entered data.

7) Binding sending of the order by clicking the button "order with costs" or "buy".

Before the binding submission of the order, the consumer can, by pressing the "back" button contained in the Internet browser used by him, after checking his details, return to the Internet page on which the customer's details are recorded and correct input errors or cancel the ordering process by closing the Internet browser.We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept your offer.

(8) Storage of the contract text for orders via our Internet store:

We store the text of the contract and send you the order data and our GTC by e-mail. You can also view the GTC at any time at http://www.monolith-shop.com/service/general-terms-conditions. Your past orders can be viewed in our customer area under My Account --> My Orders.

§3 Prices, shipping costs, payment, due date:

(1) The stated prices include the statutory sales tax and other price components. In addition, there are any shipping costs.

(2) The consumer has the option of payment in advance, PayPal, credit card (Visa and Mastercard) or Postcard and Post E-Payment to make.

(3) If the consumer has chosen payment in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

(4) The payment method 'purchase on account' requires, among other things, a successful credit check by Crif Switzerland.

You pay the invoice amount with a payment term of 30 days after receipt of the goods, we reserve the right to charge reminder costs after a delay in payment:

- Delay of 75 days after receipt of the goods 20.00 CHF reminder costs.

- Delay of 90 days after receipt of the goods 40.00 CHF reminder costs.

- Delay of 120 days after receipt of the goods 60.00 CHF reminder costs.

If after the last written request for payment still no transaction has taken place, debt collection will be initiated.

Purchase on account with installment facility: (POWERPAY)

MF Group / POWERPAY offers as an external payment service provider the payment method "purchase on account". With the single invoice you can easily pay your online purchase by invoice. If you choose not to pay within the specified time frame, you will receive a monthly invoice with an order summary in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim that has arisen and handles the corresponding payment modalities. In the case of purchase on account, you also accept our General Terms and Conditions of POWERPAY.

§4 Delivery:

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment.

(2) The risk of accidental loss and accidental deterioration of the sold item also in the case of mail order purchase only with the handover of the item to the buyer.

§5 Retention of title:

We retain title to the goods until full payment of the purchase price.

§6 Right of revocation:

Cancellation policy

Within 14 days after receipt of the order, you have the right to cancel the contract without giving reasons and to return at your expense individual or all items. The delivered products must be returned undamaged, unused, in working order and complete in their original packaging.

All returns will be checked thoroughly, if a product or the packaging has been opened and damaged, the item will not be taken back and the item will be returned to you. In this case, the customer will be responsible for the full cost of the item and any additional shipping charges.

If the item has been returned in a timely and proper manner, you will receive a new invoice from us via email.

If the invoice has already been paid, the amount for the returned goods will be credited to you and automatically credited to your next order. If the customer wishes, the amount can of course be paid to a bank or postal account.

Consequences of revocation

In case of an effective revocation, the mutually received performances shall be returned and, if applicable, drawn benefits (e.g. interest) shall be surrendered. If you are unable to return or surrender the received performance and benefits (e.g. benefits of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value. You only have to compensate us for the deterioration of the item and for any use made of it if the use or deterioration is due to handling of the item that goes beyond the inspection of its properties and functionality. By "testing the properties and functionality" we mean testing and trying out the respective goods, such as is possible and usual in a retail store.Paketversandfähige items are to be returned at our risk. You have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the goods, for us with their receipt.
